A Bylaw to Amend the "Tree Preservation, Removal and Replacement Bylaw, No. 2836". The Municipal Council of The Corporation of the City of Port Coquitlam, in open meeting assembied, enacts as follows: 1. This Bylaw may be cited for all purposes as the "Tree Preservation, Removal and Replacement Bylaw, 1993, No. 2836, Amendment Bylaw, 1994, No. 2946". Secticn 10 of the "Tree Preservation, Removal and Replacement Bylaw, 1993, No. 2836" is hereby amended by adding the following as subsection (f): "(f) cutting of trees by the City, through its officers, employees, agentz or contractors, for the purpose of read construction." Section 11 of the Bylaw is amended by repealing the present Section 11 and replacing it with the following: "11. Every person who violates any of the provisions of this Bylaw or acts in contravention of this Bylaw; shall upon Summary Conviction therefore be liable to the maximum penalty that may be imposed pursuant to the Offence Act R.S.B.C. 1979, c. 305 for each and every offence, including the imposition of the said maximum penalty for the cutting of each and every tree in contravention of this bylaw, which is deemed to constitute a separate offence hereunder and where ‘appropriate an order to restore the damage caused by the offence by replanting." 4. The Bylaw is further amended by adding the following as Section 12: (a) Council hereby authorizes the Director of Parks and Recreation to: . (i) | exempt an applicant for a tree cutting permit from the requireme to provide a tree cutting and replacement plan; | (ii) establish which of the terms and conditions set out in this bylaw applicable to the granting of a tree cutting permit apply in the case of a particular permit; Se
