SUPREME Court Justice has ordered a new trial against a company that was working on a CN Rail trestle near Terrace that collapsed six years ago, killing two workers. Scott Steel Ltd. and owner Ron Scott, who were acquitted of four charges under 5B.C.’s Worker's Compensation Act, will again stand trial for their role in the acci- dent, says an appeal judg- ment handed down Jan. 31. Justice David Tysoe ruled the initial trial judge made a mistake when he found the accident fell under the jurisdiction of the federal labour code. Tysoe said lawyers for the Crown argued Scatt Steel was under contract from CN to provide site supervision, bridge recon- struction plans and proce- dures, tools and equip- ment. CN, meanwhile, was under a contractual obliga- tion to provide the compa- ny with contract specifica- tions, engineering draw- ings, a field supervisor, two locomotive cranes and operators, in addition to material. CN had contracted Scott Steel Ltd., an Ed- monton-based company, to reconstruct the 40-year-old wooden railway trestle at Mile 8.3 on the Kitimat- Terrace line. The Oct. 27, 1997 acci- dent killed CN crane oper- ator William Hugh Carson of Kamloops and Scott Steel employee John Marti of Telkwa. Several other workers were seriously in- jured, including John Hicky of Newfoundland, whose leg was crushed and later amputated. The WCB and _ their federal counterparts con- ducted separate investiga- tions. The WCB found the 24- metre high trestle col- lapsed because so much wooden bracing had been removed that when the crane rolled out to lift steel supports into place, the structure couldn't hold. A freight train had pas- sed over the bridge just two hours earlier. The workplace had pas- sed a WCB inspection two weeks before the accident. The three-month invest- igation found Scott Steel had failed to set out mini- ment bracing requirements identifying critical compo- nents. The company also failed to make sure the trestle could withstand the weight of the crane. Training will continue as usual, and apprentices and employers will be receiving letters explaining changes that may affect them during this time.
