The Provincial Livestock Protection Act is basically the Animal Control By-law for the non Municipal areas of the Province and, accordingly, the Statute does not apply within the boundaries of Municipalities. There is, however, a provision that the Provincial Government can make the Statute or any part of it apply within a Municipality by approval of the Provincial Cabinet. On June 9th, 1977 following some problems that had arisen within a Municipality respecting the control of vicious dogs two sections, numbers 6 and 8 of the Livestock Protection Act were made applicable within all Municipalities. These Sections read as follows: Dogs causing injury or demare G. Where a person finds a dag (a) running at large: and (b) attacking or viciuusly pursuing a person or a domestic antral, he may kill the dog. 1973-114-6. Order to Lil dug . $. (1) The Provincial Court may, op application and on being satisfied that a dog has filled or injured, or is likely to kiff or injure, a person or a domestic animal, order that the deg be killed in a manner prescribed in the ‘order. — @) A peace officer may, with the consent of the commissioner and on being satisfied that tie situntion is erpentand an application cannot reasonably be aiade to the court under suosection (1), make an order under subsection (1).
