BETWEEN:
DISTRICT OF col UITLAM, a municipal corporation
incorporated under the "Municipal Act", R.S.8.0.,
1960, and amendments thereto, (hereinafter called
"the District"),

OF THE FIRST PART

THE CORPORATION OF THE CITY OF PORT COQUITLAM,
a municipal corporation tncorporated under the
"Municipal Act:, R.S.B.C., 1960, and amendments
thereto, (hereinafter called “the City ").

OF THE SECOND PART

WHEREAS the District is the Owner in fee simple of land situate
lying and being in the Municipality of Coquitlam, Province of British
Columbia, and more particularly known and described as:

Lot Fifty-six (56) of District Lot Three

Hundred and Eighty-one (381), Group One (1),

New Westminster District, Plan Thirty-seven

Thousand One Hundred and Sixty-nine (37169).

"AND WHEREAS the District and the City have constructed upon the
Said lands a buflding known as the Justice Building (hereinafter called
"the Justice Building");

ANO WHEREAS the City has paid one-third (1/3) of the
construction costs, and the District two-thirds (2/3);

AND WHEREAS the City agreed with the District to pay to the
District a portion of the costs for the maintenance, administration and
Operation of the said lands and fixtures and equipment therein contained;

. AND WHEREAS Pursuant to section 644 of the Municipal Act,
R.S.8.C. 3960 and amending acts, but subject to the Administration of
Justice Act and the Police Act and section 643 of the said Municipal Act,
it is the duty of each municipality to bear the expenses necessary to
getierally maintain law and order ja the municipality; and provide an office
for the police force tn the minicipality and Provide premises as a Place of
detention or make an agreement with some other municipality for the use as

required of an office or of Premises as a place of detention;

NOW THIS AGREEMENT WITHESSETH THAT in consideration of the mutual

covenants and agreements herein contained and Subject to the terms and

conditions hereinafter set out, the parties agree as follows:

1. The City shat} pay to the District a share of the costs of
maintenance, administration and operation of the Justices Building and the
lands on which the same is Situate, in the following manner:

a) For the calendar year 1977, and Commencing from January Ist
1977 A... and for each and every calendar year thereafter,
the District shall cause to be Prepared a budget for operation,
maintenance and administration which shall be submitted to the
Parties on or before the 30th day of Hovember;

b) If the budget aforementioned ts not finally 8pproved by the
Tast day in February in any year for the year under review the
budget shal] be referred to arbitration Pursuant to the
"Arbitration Act", 1960, chapter 14 and amending acts, which
shall render its decision on or before the 15th day of April,
and such decision shall be binding on both Parties hereto;

c) The City shalt Pay to the District a share Of the costs, as
aforesaid, after the acceptance of the approved budget or the
report of the arbitration, which shall be computed to be the
ratio that the total of the following components for the City
and the District respectively would bear one to each other:

t) in each year the Statistics Canada Census figures for
Population Currently applicable sha}] te added to;

Ti) the number Of police calls received in the Preceding
year from each Party's jurisdiction.

d) An adjustment shall take place on or before Harch 33st, of
the year next so as to reflect the City’s share Of actual

expenditure {ncurred for the past year;

2. The City agrees with the District that the District shall pay

in accordance with approved budget or report of the Arbitrator, a1}
Operating, administrative and maintenance Costs and capita] expenditure
Of the Justice Building and Tands, and of costs of;

1) Hatntenance and safe keeping of prisoners;

ii} Any other required employees

itt) AN costs of fringe benefits;
