DUP CORPORATION OF THE CITY OF PORT COQUITLAM

BY-LAW NO. 1614

A By-law to authorize the City to enter into Land Use Contract No. 28,
WHEREAS the "City of Port Coquitlan Zoning By-law, 1969, No, 918"
as anended deeignates cercain areas of land within the zones set out
therein as “Developzent Areas";

AND KHESEAS the Lands hereinafter described are situate within an
area so designated;

AND WHEFEAS the Owner of the said lands has made application for a
Lane Use Contract to authorize works, develepnent, and use sone aspecta
of which are not in confornicy with the relevant City By-laws as the
sae apply fo the zone in which the said lands are situate;

AND GHEPEAS the Council has given due regard to the following
coasiderations:
1. (a) the promotion of health, safety, convenience and welfare of
the public,

(b) the prevention of the overcrowding of land, and the preservation
of the azenities particular to any zone.

(c) the securing of adequate light, air and access. .

(4) the value of the land and the nature of its present and prospective
use and occupancy,

(e) che character ef each zone, the character of the buildings
alveady erected and the peculiar suitability of the zone for particular .

the conservation of property values.

the developnene of areas to promote greater efficiency and.

the inpact of developcent on present and future public costs..:

(ce) the beccerment of rhe environnent.

(4) the fulfilleent of community goals.

(ce) the provision of necessary public space.
and it {s deesed desirable to enter into ‘Land Use Contract No. 28 in the
‘fors and to the extent hereinafrer provided;

NOW THEREFORE the Municipal Council of The Corporation of the City -
of Port Coquitian, tn open meeting assembled, “enacts as follows;
2. The Council of The Corporation of the City of Porr Coquitlam is

hereby authorized and empowered to enter into a Land Use Contract with

P.C.S. Industries Led., 933 Jarvis Street, Coquitlam, B. C,

in the form and to the extent eet forth in “Land Use Contract No. 28"
which is the Schedule herete annexed and made part of this By-law.

The said Land Use Contract No. 28 shall extend to and shall regulate
the development and use of the lands described chercia,
3. Land Use Contract No. 28 shall have the force and effect of &
xestrictive covenant running with the land described therein and shall
be registered in the New Westminster Land Registry Office.
4. This By-law may be cited for all purposes 4s “Land Use Contract No. 28
Authorization By-law, 1978, No. 1614".

Read a first tine by the Municipal Council this Fourteenth day of
August, 1978,

Read a second tine by the Hunicipal Council this Fourteenth day of
August, 1978,

Public Hearing held this Twenty-eighth day of August, 1978.
