Finitions: in this contract, unless the context otherwise requires: “Chief Inspector" shall be construed to mean and include the Building Inspector for che Municipality and his duly authorized assistants er such Consultants as may be appointed to act for the Municipality. : "Complete" or "Completion" or any variation of these words when used with respect to the work dr vorks referred to erein shall mean completion to the satisfaction of the Municipal Engineer of the Municipalicy when se certified by hin in writing. “Wunicipal Engineer" shall be construed to mean and daclude the City Engineer for the Municipality and his duly authorized . assistants or such Consulting or other Professional Engincers as tay be appointed to act for the Municipalicy. “Yunietpal Planner" shall be construed to mean and include the Plaaning Officer for the Municipality and his duly authorized assistants or such Consultants as may be appointed to acc for the Municipaliry. “Work” or "Works" or any variation of these words shall: be construed to sean and include all work required to be done for the setting-out, the execstion and the completion of this Contract to the satisfaction of the Municipality. The Developer is the holder of a registered interest in ALL 44D SINGULAR that certain parcel or tract of land and premises situate, lying and being in the City of Port Coquitlas, in the Province of British Coltzzbia, waieh said lend is deseribed in Schedule A” hereof and is hereinafter called "the land", Consents: 3. , The beveloser has obtained the consent of all persons holding auy registered iaterest in the land as set out in the Consents to the use aad developnent set forth herein, which Consents are attached hereto. Uses: 4, The land, including the surface of water, and any and all buildings, structures and inprovenents erected thereon, thereover or therein shall be used for the putpose or purposes specified in-Schedule fon hereto and for ro other purpose or purposes whatsoever. 5. No sign shall be erected upon the land or on any building or structure thereon except in compliance with the hereinbefore deseribed plans and specifications and further subject to the satisfaction and ° approval of the Municipal Planner. Off-street parking and loading spaces shall be Provided, located and constructed in accordance with tha hereinbefore described Plans and specifications and further subject to the satisfaction and approval of the Municipal Planner. Subdivision: subdivision: 8. lo land shall be subdivided except in cowpliance with and according to the plans and particulars Set out in Schedule "Cc" hereto. Landscaping: . 9. ALL landscaping, surface treatuents, fences and screens shell be constructed, located, provided and maintained in compliance with the hereinbefore described Plans and specifications and further subject to the satisfaction and approval of the Municipal Planner, - i6. All utilities, including water, Sewer, gas, telephone and electricity shall be placed, provided and constructed in cempliance with the hereinbefore described plans and specifications and further subject to the satisfaction and approval of the Municipal Engineer. Application of Provincial Building Code ate,; 11. " Except as provided herein all buildings and structures shall be constructed strictly in complience with applicable Municipal By~laws and the Provincial Building Code. Works, Construction, Design, and Security Therefore: 12. (a) To facilitate the use and development of the lard, the Developer covenants and agrees to provide, construct and install such off-site works and services as are deened necessary by the Municipal Engineer to serve the land and development thereon and to pay for the entire cost of ‘the completion of the aforesaid off-site works and services.
