Revised Section 215 Covenant for Lot 43
Genstar Phase 8B Subdivision
(Public Works Committee Meeting January 16, 1990)

Recommendation:

That the Mayor and City Clerk be authorized to execute the attached
revised Section 215 Covenant to be registered against Lot 43 of Genstar's
Phase 8B Subdivision.

Background and Comments:

An earlier report on this subject (copy attached) was forwarded to
Council fer consideration at its regular meeting of January 8, 1990. =A
decision on this matter was deferred until an opinion has been obtained from

the Solicitor regarding whether the City can effectively protect itself from
claims arising from NON-ENFORCEMENT of the Covenant. .

The Solicitor's opinion is attached. His recommendations have been
incorporated into the revised Section 215 Covenant which is also attached.
Council's approval of the recommendation is requested. .
