GYRD Response to BI17 9 = The Municipal Act, 1983

duly 14, 1983

Background

On July 7, 1983 the Minister of Municipal Affairs introduced Bill 9
(1983) - The Municipal Amendment Act (copy attached). The 8111, which
if passed would take effect by regulation, would have two consequences
for the GVRD: .

© It would remove the statutory responsibility under the Municipal Act
for regional districts to carry out regional planning and = to
maintain and enforce Official Regional Plans; and

6 It would make the enactment of Official Settlement Plans for
electoral areas an option rather than a requirement of a regional
board.

This memorandum deals only with the regional planning implications of
the Bill.

Board Policy

A similar provision was contained in 8111 9 (1981) - The Land Use Act.
Its successor, Bill 72 (1982) also would have removed the power of
regional boards to prepare regional plans or enact Official Regional
Plans; although ft provided for a regional district to carry out
regional development studies, this could onty be done subject to
extremely onerous requirements for Municipal agreement to such
activities.
