Brown Director of Community Planning SUBJECT: Rezoning Application 9/82 2352-58 Shaughnesay RECOMMENDATION: That City Council direct the City Clerks office to prepare a bylaw amending the zoning on lots 2 and 3, Blk. J., Deol. 289, Plan 2076 from RS-i to RT=1. BACKGROUND: This application was submitted June 4, 1982 to bring an existing non-conforming fourplex into conformance with the Zoning Sylaw. City Council at the regular meeting of June 23, 1962, decided against proceeding with rezoning the property to a Multiple Family zoning designation (RM~-3) as it would be slightly deficient of the minimum lot size permitted. Subsequent to Council's decision, the spplicant made several attempts to negotiate purchase of the deficient 12 square metres, but was not successful. COMMENTS: The owner's reason for applying to bring this epartment building into conformance with the zoning bylaw, is for mortgage renewal purposes. The bank holding the mortgage are reluctant to renew it until they have assurance that it could be rebuilt. Following City Council's decision to not rezone the Lat to an RM designation, the applicant hes negotiated with his banker to rezone the property to a lower density designation. The reasoning for selecting an RT-1 designation was that it would still provide a guaranteed flow of income, and should also be acceptable to City Council. This property is located in the "Shaughnessy Corridor" Phase 1 area for redevelopment. In view of that factor, this rezoning will implement City Council'a policy to encourage apartments along Shaughnessy Street. In addition to the fact that this rezoning will not affect the current use of this property ror diminish the City's control over a future rezoning application for apartment use support the proposal to rezone the property to am RT-1 designation.
