Freeman, City Clerk Cs Re: "Senior Citizens Sewer Rates and Charges Partial Waiver By-law, 1974, No. 1305” Council will recall that the above-noted By~law was adopted on March 25th, 1974. Subsequent to this date we were advised by the Department of Municipal Affairs that since the By-law dealt with a sewer tax rate it was being advanced to the Lieutenant-Governor in Council for approval, notwithstanding the fact that the authorizing legislation does not appear to make such a provision. The approval of the Lieutenant-Governor in Council is contained in Order in Council No. 1264 and a slight difficulty is presented in that final passage of the By-law must come after the Lieutenant-Governor's approval is granted and not before. This can easily be remedied, however, by adoption of the following two separate resolutions and we would reconmend them to the Council: . 1. “phat reconsideration, final passage and adoption of the "Senior Citizens Sewer Rates and’ Charges Partial Waiver By-law, 1974, No. 1305" as given on the 25th day of March, 1974, be rescinded." 2. “That By-law No. 1305 be reconsidered, finally passed and adopted.” See, “City Clerk
