Paters., P, Eng., City Engineer SUBJECT: Draft Resolution for Canfor Property Exchange - Works and Services Committee, April 2, 1985 RECOMMENDATION: That Council adopt the following draft resolution as an alternate to the letter which was on the Council Agenda on March 11, 1985: This Council agrees that it will not object to the continuation of log storage and existing dolphins on Cantor's existing water lot lease from the Fraser River Harbour Commission, notwithstanding that the lease may extend in front of lands which are being transferred to the City at this time. BACKGROUND. AND COMMENTS: Council witl recall that as part of a property exchange which provides the City with a continuous strip of property for the dyke on the south side, we were receiving a strip of foreshore property from Canfor. Cantor's concern with this exchange was that they might be then forced to relinquish a part of their log storage rights on the river. Council! considered a previous draft letter to Cantor as inappropriate and requested that the Committee review the matter, Bese In support of the above draft resolution, the Committee makes the following points: 1, The City does require the piece of property in question. The outfal | from the Harbour Street.Pump Station sits directly on this little triangle of property. During the design of the dyking works there wars an understanding between the City and Canfor that the ownershio of this property would be resolved by means of an exchange. It has taken this long to agree to terms for an exchange and to have the necessary survey plans drawn up. The City is not in a position to give permission for log storage. This is the prerogative of the Fraser River Harbour Commission who leases the water lots. The City, if it does not acquire title to this piece of land, has no say whatsoever in the matter. If the City does acquire title, then it is in a position of either objecting or not objecting to the water lot lease.
