DISTRICT OF COQUITLAM BY-LAW NO. 1421, 1984 A By-Law to prohibit the Sounding of Train Whistles in certain neighbourhoods of the District of Coquitlam WHEREAS the Railway Act being. Chapter R-2 of the Revised Statutes of Canada, 1970, as amended, Section 248, provides as follows: "248. (1) When any train is @pproaching a highway crossing at rail level the engine whistle shall be seunded at least eighty rods before reaching such cross- ing, and the bell shall be rung continuously from the time of the sounding of the whistle until the engine has crossed such highway. (2) Where a by-law of an urban municipality prohibits such sounding of the whistle or ringing of the bell in respect of any such crossing or crossings within. the limits of the municipality, the by-law shall, if approved by an order of the Commission, to the extent of the prohibition relieve the company and its employees from the duty imposed by this saction. (3) In subsection (2) the expression "urban municipality® means ’ (a) a citys (b) a town; or (c) any other municipality that contains @ thickly. populated area and that the Commission, on the application of such municipality, declaras to be an urban municipality within the meaning of that sub- saction.”® , AND WHEREAS tho whistling of the locomotives on the Canadian Pacific Railway track, whilst traversing the District of Coquitlam, disturbs the heace andaquiet of the residents of the District of Coquitlam, both by day and at night, in the neighbourhood of the at- grade highway railway crossings on Westwood Street and Pitt River Road, in the District of Coquitlam; AND WHEREAS the necessary protection devices as raquired by the Canadian Transport Commission have been erected on both sides of each level highway railway Groasing on Westwood Street and Pitt River Road;
