NOW THEREFORE in consideration of sie sun of One Dollar ($1.00) paid by the City to the Covenantor, receipt and sufficiency cf which is acknowledged, the Covenantor covenants and agrees as follows: Building Construction 1. Every building or structure built on the Land shall be constructed strictly in accordance with the building design guidelines attached zs Schedule “A” to this Covenant Withholdi 2. The City may withhold a building permit fo: any building proposed to be built on the Lands unless the plans for the building are in compliance with this Covenant Use of the Land 3. The principal building on the Land shall be used as a one-family dwelling only and shall not include any secondary suite or awdliary dwelling unit. Inspection 4, The City, its officers, employees and agen sball upon not fess than 24 hours notice in writing to the Covenantor have access to the Land and buildings on the Land as may be necessary to ascertain compliance with this Covenant. Eff. f nan 5. This Covenant runs with the Land and is binding upon the owners of the Land from time to time and every reference herein to the Covenantor includes the Covenantor’s successors in tide. The Covenantor shall not be liable for any breach of this Covenant occurring after the Cavenantor has ceased to be an owner of the Land. Indemni 6. The Covenantor shall indemnify and save harmless the City, its officers, employees and agents against any proceeding, claim or demand which muy be made by any person in relation to the restrictions imposed by this Covenant or the obligations required to be performed under this Covenant. This indemnitw applies to any act or omission occurring while the Covenantor is an owner of the Land, notwithstanding that the Covenantor may have ceased to be an owner of the Lead, and shall survive the discharge of this Covenant from title to the Land in relation to acts or omissions occurring before such discharge. | ITEM D5
