LEGAL BACKGROUND: Lots 2 and 3, Block 1, NE 1/4, Section 6, Township 40, Plan 9752. BACKGROUND: The subject properties together with lot one are the only remaining land parcels at the east end of Prairie Road to be developed. The Planning Department has already prepared a subdivision guide plan for the development of ‘ these properties. The ideal situation will be for all three properties to be developed jointly, following the subdivision guide plan. However, Lot one at this point in time is not in a position to be developed. ‘The owner of lots 2 and 3 is therefore requesting partial develop- ment of these two properties by creating two RS-1 lots fronting on Prairie Road. The remainders of lots 2 and 3-are to be consolidated and the development of which will proceed with lot one in the future. The proposed partial development does not jeopardize the effectiveness of the subdivision guide plan. The consolidated parcel, unfortunately, has a problem in that the road frontage is less than 10% of the perimeter of the parcel as required by the subdivision control by- law and the Municipal Act. However, under Section 712 (b) of the Municipal Act, the Council has the power to approve reduction of frontage to below 10% by affirmative vote of 2/3 of all the Council Members. If this development is to proceed, such Council approval is necessary. RECOMMENDATION: The Planning and Zoning Committee recommends that the rezoning application be advanced to Public Hearing and that upon final approval of the rezoning, frontage exem- ption be approved in order to effect the consolidation of the remainders of the two properties. an aad L.
