BY-LAW NO. 1427

A By-law to authorize the execution of Landecaping Agreements by

The Corporation of the City of Port Coquitlan,

The Municipal Council of The Corporation of the City of Port
Coquitlam, in open ueeting assembled, enacts as follows:
1. The Mayor and City Clerk are hereby authorized to enter into Landscaping
Agreements as may be required from time to time in the processing for approval of
rezoning applications, subdivisions, or the issuance of building pernite.
2. Zach Landscaping Agreement aforesaid shall be in the form annexed to
this By-law as Schedule "A" tugether with such minor deletions or alterations
a3 are necessarily required te accurately reflect the particular circumstances
of each individual rezoniag application, subdivision, or issuance of building
permit.
3. The Mayor and City Clerk are hereby authorized to sign such
Landscaping Agreements on behalf of the City and affix the Corporate Seal
thereto,

This By-law may be cited for all Purposes as the "Landscaping

Agreement Execution Authorization By-law, 1976, No. 1427",

THIS AGREEMENT made the

BETWEEN:

THE CORPORATION OF THE CITY OF PORT COQUITLAM,
a City Municipality duly incorporated under the
laws of the Province of British Columbia, and
having its offices at 2272 McAllister Avenue,
City of Port Coquitlam, Province of British
Columbia,

(heretnafter called the "City")

OF THE FIRST PART:

(hereinafter called the "Applicant")

OF THE SECOND PART:

WHEREAS the Applicant desires to construct a building or buildings ©
on certain lands and premises within the City of Port Coquitlam, in the

Province of British Columbia, and more Particularly known and described asi

which lands shall hereinafter be veferred to as "the lands";

AND WHEREAS the Applicant has made application for a building permic
under the provisions of the "City of Port Coguitlam Building and Plumbiag Code
Administration By~law, 1974, No. 1298";

AND WHEREAS the Applicant proposed to landscape such part of the lands
not covered by a building and has submitted a plan thereof which said plan is
annexed hereto as Appendix 1;

NOW THEREFORE this agreement witnesseth tat in consideration of
these premises, the Applicant covenants and agrees as follows:

1. The Applicant covenants and agrees to complete the landscaping of

the lands in accord with the provisions of the plan annexed hereto as Appendix
I and to complete the construction and installation of the plan-of landscaping
shown therein to the satisfaction of the Planning Officer by the

2. As security for the due and proper performance of all the covenants
and agreements in thic contract contained, the Applicant has forthwith deposited

with the City by Letter of Credit the sum of
