Penalties to individuals increased substantially. .

New environmental and fisheries legislation for an increasing variety of offences are
being passed by the Federal and Provincial Governments. CEPA was passed in 1988
and major changes were made to the Fisheries Act on January 17,1991. |

Charges for offences are not only including corporations, but individual officers.

Status Quo

Provide better protection and indemnification for local government officials by
changing Sections 262 and.755.1 of the. Municipal Act as shown in Appendix IJ, and —
by changing sections 180 and 294 of the Vancouver Charter as shown in Appendix J.

Change Provincial Environmental Legislation to exclude charges _ against local —
government officials who, while performing required duties in good faith, contravene.

MENDATION

Request. the Provincial Government to change sections 262 and 755.1 of the
