THE CORPORATION OF THE CITY OF PORT COQUITLAM ’ ITEM IIL Re: Council Policy on Spoil Deposit . From time to time the City receives requests from residents to have spoil from City construction projects deposited on their private property as fill. In some cases such requests help the City in disposing of spoil which would otherwise have to be hauled a longer distance toa dump. It is therefore desirable to be able to dump spoil on private property under those circumstances. On the other hand, it is possible to see where such a p-rocedure might lead to abuses and possibly complaints to Council from taxpayers. The Committee feels, therefore, that a policy regarding the deposit of spoil on private property be adopted by Council so that there is no question of the correct procedure. The Comm- ittee therefore recommends the following policy: POLICY FOR SPOIL DEPOSIT ON PRIVATE PROPERTY 1. The City will accept requests for spoil deposit from residents of the City through the City Engineer. 2. Where spoil is available from a project, it will be delivered to private property only if the following conditions are met: (a) the City itself has no use for the material (b) it costs the City less to dispose on private property than to haul the material away to a dump (c) the owner of the property agrees in writing to accept the material as is without the right of selection or rejection (a) the owner agrees in writing to absolve the City of all blame for any damage caused by City vehicles entering onto private property in order to dump the spoil. Where several property owners have applied to receive spoil from a given project,. the resident who is closest to the project site will receive the first right of refusal, and where several requests are approximately equidistant from the site, the first right of refusal would go to the resident who made the first application.
