ALL roadway improvements and utilities, including water, sever, gas, telephone, and electricity shall be placed, provided, and constructed in compliance with and according to the plana prepared by the Developer and approved by the City Engineer. 12. The Developer covenants and agrees to apply for a building permit under the provisions of the “City of Pore Coquitlam Building and Plumbing Code Administration By-law, 1974, No. 1298" and pay the requisite buiiding permit and plumbing peruit fees prescribed therein plus the sum of $1,200.00 which said sum the City shail credit to the Waterworks Utility Capital Replacement Fund. 13. (a) To facilitate the use and development of the land, the Developer covenants and agrees to provide, construct and install such off-site works and services. as are deemed necessary by the Engineer to serve the land and the development thereon, and to pay for the entire cost of the completion of the aforesaid off-site works and services. The said off-site works and setvices shall be completed to the satisfaction of the Engineer in accordance with plans and specifications es approved by the Engineer prior to the granting of necessary approval and occupancy permits by the appropriate officer of the Muaicipality. Without limiting the generality of the foregoing, these off-site works and services shall include those items set out in Section " of Appeadix 3 hereto. In addition, the Developer covenants and agrees to pay to the Municipality the entire cost of connecting 11 required watez, storm, and sanitary sewer services to the said buildings. (b) As security for the due and proper performance of the landscaping in accord with the provisions of the Plan attached hereto as Appendix 5, the Developer covenants and agrees to deposit with the Municipality by Letter of Credit the sum of Fifteen Thousand Dollars ($15,000.00) drawn on the Main and Hastings Streets Brauch of the Royal Bank of Canada. The Municipality acknowledges it may take a period of several years to complete the landscaping details in Appendix $ and that the amount of the Letter of Credit may be altered from time to time to reflect the progress made in completing the Landscape plan aforesaid, (c) As security for the due and proper performance of all the covenante and agreements in this contract contained (except the landscaping herein- before referred to) the Developer covenants and agrees to deposit with the Municipality by Letter of Credit the sum of $82,000.00 drawn on the Main and Hastings Streets Branch of “he Royal Bank of Canada. (d) The Developer agrces that if the aforesaid landscaping, off-site works, and services are not completed or made in accordance with the terns of this agreement, the Municipality may complete the work or make the payments at the cost of the Developer and deduct from the deposit held by the Municipality the cost of suck completion or payment, and the balance of the deposit shall be returned to the Developer, less any administration fees required. If there is insufficient money on deposit with the Municipality, then the Developer vill pay such deficiency to the Municipality immediately upon receipt of the Municipality's bill for completion. It is understood that che Municipality may do such work as required to complete the said works and services elther by itself ox by Contractors employed by the Municipality. If all the Developer's covenants are carried out as herein provided, then the deposit, less administration fees, shall be returned to the Developer. 14, The Developer further covenants and agrees to contribute forthwith to the Municipaliry the sum of $22,922.30, being the net total of those amounts set out in Section “B" of Appendix 3 hereto, required to defray the orcessive costs incurred by the Municipality for the purposes set out herein and which the Municipality covenants and agrees to apply to the cost of those works and services set out in the said Section "B" of Appendix 3 hereto. 15. The Developer covenants and agrees not to deposit any material or debris upon any roads during the construction of the said work and to continuously carry on the construction of the said work in a good and proper workmanlike manner causing as little disturbance to neighbouring properties as is reasonable under the circumstances. In the event that any material or debris should be deposited upon any road during the construction of the vork or should the construction by the Developer constitute a nuisance to neighbouring Properties of the work the Developer covenants and agrees that the Municipality may forthwith remove such material or debris or put right such nuisance at the expense of the Developer, the cost thereof to be deterrined by the Engineer. In the event that construction of the work ceases for any period of time in excess of thirty days the Developer covenanta and agrees that the Municipality may forthwith enter upon the property and construct thereon-a solid board fence not greater than eight feet in height nor less then six feet in height surrounding the entire perimeter of the project and that in so doing che Municipality accepta no responsibility for the suitability or adequacy ef the said fence erected for the benefit of the Len eri meat woe etary
