BACKGROUND & COMMENTS: The Tree Preservation Bylaw has been in place since November 1993, The Parks and Recreation Department have had an opportunity to process three tree cutting permits and have experienced some difficulty in administering the bylaw. Sp ecifically the bylaw allows no flexibility in the interpretation. For example, ifthe City has approved the construction and location of roads in a subdivision, there would seem to not be a need to require a tree cutting permit. Earlier this year, Bill 25 was brought into force that contains e number of amendments to the Municipal Act. One of the amendments is the addition of Section 929.08, (a copy of this is attached to the report), which authorizes delegation of discretion to City employees . in the tree cutting permit part of the Act ( Part 28, Division 4.1). The proposed amendment in appendix 1 would give the Parks and Recreation Director tnore authority, in reference to the terms and conditions of the bylaw, and to act as a delegate of Council with respect to certain enforcement issues. 43
