British Columbia and having offices at 1036 Cambie Road, District of Richmond, Province of British Columbia, (hereinafter called the "Developer") OF THE SECOND PART: WHEREAS the Developer is the Registered Owner of an Estate in fee simple of all and singular that certain parcel or tract of land and premises situate, lying and being in the City of Port Coquitiam in the Province of British Columbia being more particularly known and described ass Lot "B" Block 3, District Lot 379, Group 1, Plan 1213 New Westminster District. (hereinafter called "The Land"); - ANY WHEREAS the Municipality and the Developer have entered into Land Use Contract No. 3 respecting The Land which said Land Use Contract Was registered in the New Westminster Land Registry Office on January 29th, 1973 under No. 310176; ND WHEREAS Architectural Plan A-4 thereof indicated that certain business identification signs provided therein would be “individual illuminated ~ signs to later detail"; a AND WHEREAS an Agreement has now been reached between the Municipality and the Developer respecting such later detail. . : . NOW THEREFORE this Agreement witnesseth that in consideration of the premises and the conditions and covenants hereinafter set forth, the Municipality and the Developer covenant and ‘agree as follows: 1 The six signs shown on Architectural Plan A-4 to be located along the first story rooftop level facing Shaughnessy Street shall be deleted and not constructed, 2. The erection of two signs, one at either end of the building mounted at right angles to Shaughnessy Street and located on the Parapets at the first story rooftop level shall be permitted, , ; 3. ; The two signs referred to in Section 2 hereof shall each be 4" x 7° in size and the top of the said signs shall not be more than 5' above the Parapet, 4. The signs permitted may be illuminated but shall not flash. 5. The signs permitted shall be properly uaintained, repainted fron time to time, and refurbished as Necessary to prevent deterforation and ta keep the said signs in sound condition and unblemished appearance. 6. Except as otherwise provided herein all provisions of the “City of Port Coquitlam Sign By-Law, 1969, No. 936" shall apply to the said signs.
