COUNC _ JAN 12 1976 10: MAYOR AND COUNCIL DATE: JANUARY 7,° 1976 FROM: PLANNING AND ZONING COMMITTEE REFERENCE: R#1/76 SUBJECT: Application to rezone a 10-acre parcel at Cedar Drive and Lincoln Avenue to RS-1 from RS~2 for subdivision, LEGAL Lot 116, NE, Section 6, Township 40, Plan 28650. DESCRIPTION: ° BACKGROUND: Council will recall early in 1975, an application to rezone the subject land was presented to Council for consideration and was subsequently rejected. The developer has recently re-applied for rezoning of the same land for subdivision. In consultation with the Engineering Dept., it was indicated that servicing the site would not be difficult. A proposed subdivision pian submitted by the developer is attached for your consideration. Some of lots shown on the subdivision plan have a width below 60 feet. This width reduction is supported by the Planning and Zoning Committee. It is felt that deeper lots can be created which, in the opinion of the Committee are more - desirable. Please note that, except for a 20-foot strip, the road allowance to the west of Cedar Ditch is included in the development site. Council will recall back in 1972, a 3-way land exchange took place, involving the City, Mr. Spani of Meridian Developments and School Board. An agreement was made between the City and Mr. Spani as one of the conditions of the exchange, that the City would abandon that portion of the road allowance for a sum of $1.00. The transfer of land to Mr. Spani, however, has never been completed. This is the reason the land is still shown on the legal plan as a road allowance. Ooeacessued
