November 4th, 1974 In its report, the Committee stated that the application was considered and while sympathizing with the applicant, feels that rental accommodation in the City must not be further red-:cad; furthermore, approving the Strata Title Plan would defeat the intent of the Strata Title Act which stresses very strongly that in considering approval for conversions, priority should be given to rental accommodation over privately-owned housing. Moved by Alderman Ranger: Seconded by Alderman Traboulay: That as recommended in a report from the Planning & Zoning Committee, October 3lst, 1974, Application SS#21/74 to subdivide by Strata Title Plan an existing duplex on Lot 1, Block P, D.L. 466, Plan 16570, located at 1680 Prairie Avenue, be not approved. Defeated. Aldermen Ranger and Traboulay voted in favour of the resolution. Prior to defeat of the foregoing resolution, a discussion ensued, and Alderman Keryluk stated he felt this was a special situation as: 1. the applicant was recently widowed and is not physically able to maintain the duplex; 2. Section 5(2)(b)(i) of the Strata Title Act which states "the priority of rental accommodation over privately owned housing in the area"— is not the sole consideration under the circumstances. Alderman Laking stated he agreed with the views expressed by Alderman Keryluk, as did Alderman Mabbett, who added he would not like to see the duplex downgraded by the owner's stated inability to maintain it. Alderman Traboulay stated did not agree with Alderman Mabbett's concern that the building would be downgraded, and commented that the trend of Council has been to grant strata title approval in cases such as this. Alderman Ranger pointed out that in all such previous applications, the resident tenants wanted to purchase the units involved.
