Director of Community Planning , Oe Aa Pent rar 3374 Sefton Street M4 Development Variance Permit JAN ag 0 Planning File No. 79/89 RECOMMENDATION ¢ The Planning Committee recommends that in view of the high quality of this project, the particular location of this commercial building backing onto a lane and commercial uses beyond, the lack of windows on the residential building to the rear and further in consideration of the history of this property, where the applicant followed the instructions of the Planner to develop a five unit townhouse complex rather than an apartment building of nine to twelve units, the recommendation of the January 15, 1990 report from the Planner be approved. The Committee further recommended that Council states that this application is approved due to the unusual circumstances surrounding this project and the Planner be advised not to encourage similar variations in the future and that this approval is net to be considered as precedent setting. BACKGR UND On Monday, January 22, 1990 Council in Committee referred the referenced back to the Planning Committee for consideration. The issue was put on the Agenda of Planning Committee of January 24, 1990 and a delegation from the applicants was present to ciacuss the project. After some discussion on the history and the special circumstances of this project (see attached minutes of Planning Committee) the Planning Committee decided to recommend to Council to endorse the recommendation of January 15, 1990 from the Director of Community Planning and recommend that Council pass a second motion to indicate that approval of this project should not be considered as precedent setting for similar applications.
