SUBJECT: Ben Arnold Town House Propasal
draft Restrictive Covenant

RECOMMENDATION:

That City Council approve the draft Restrictive Covenant
prepared by the City's Solicitor for registration against the

Subject property.

COMMENTS:

This covenant was prepared to provide assurance that the
plans submitted for approval of the rezoning are what is
constructed. To that end the Solicitor has prepared a covenant
to tie drawings submitted by the applicant to the property.
This is to be accomplished through a Covenant registered

against Title of the Land.
