Randolph Peterson tooked down at Samson, lying almost still in his hospital bed. He loved the guy. He was his best friend. But what a mess, Ah, Samson, what a writer you could have been if you wouldnt have hit the bottle. Without Daddys money, you could never have made it through fife. Just the past year alone, lung dis- ease, heart problems, high blood pressure. Not to mention alcoholism, Samson lay with his eyes closed. He pretend- ed he hadnt heard a word. Just get me out of hare, Randalph spoke quietly to his friend, Go Samson. Its against your bast interests. Its against my best judgment. Bul lm doing it on one condition, That you take oxygen continu- ously, Without that you can suffar mental dys- function. Lack of oxygen will make it difficult to think. And given the combination of drugs and oxygen, you might even become delusional. But its your lifs....if you can call it a life, Samson went home, He was a bachelor, His loyal but weary sister and her daughter were waiting to take care of him. They had been instructed on how to administer tha oxygen. On the third day, Samsons voice boomed out calling for his sister. Mary, | want to make a will, Hare ara my notes, Those ara my wishes. Samsons daughter-in-law typed the will, and had Samsons signature properly witnessed. BY CLAIRE BERNSTEIN BASED ON ACTUAL COURT CASES Shortly afterwards, Samson was taken to the hospital. Randolf took one look at him and shook his head, I knew it. Looks like he didnt take ine oxygen regularly, Samson died. He left 3 wills in all. His nephew Leo, the beneliclary of the second will, was furious. He had been cut out of the last will, He went to court to have Samson declared insane for the fast will. Frustrated, Leo insisted, Your Honour, Samson was nuts. He Xept drinking even though it was killing him. He was taking oxy- gen and drugs which made him delusional, Ke left the hospital when he shouldve stayed, | made sure he got treatment. Yet, he cut ma out of the will. These arent the actions of a sane man. Declare the will invalid. Tearfully, Mary pleaded Saisons case, Your Honour, my brother wasnt insane. Ha knew exactly what he was doing, | know, ! was with him until the end. He left the hospital because he wanted to die at home. Samson followad lhe proper procedures for the will. He had it witnessed. Dont ignore my brothars dying wishes. ; Should Samsons will be declared invalid? Youl Ba The Judge. SPONSORED BY » ook & GRUg, “Helping People Cope with the Legal System”
