Arch., M.C.I.BP, Director of Planning City of Port Coquitlam 2580 Shaughnessy Street Port Coquitlam, B.C. V3C 2A8 Dear Carlos: Rer M=3 Clean Industrisl Zone Our File Ne. 19-8~109 Further to your memorandun yesterday, we have considered whether ths proposed dafinition of "light industrial" to be added to Section 101 of "port Coquitlam Zoning Bylaw, 1987, No. 2240" igs enforceable. In our view the definition can bea interpreted and applied by a court, and a yrestriction to "light industrial" use will be enforceable provided some discration is exercised in the circumstances in which enforcement is sought. A recommended change to the wording of the proposed definition is set out in the last paragraph of this letter. The proposed definition is as follows: "Light Industrial Use means an industrial use taking place entirely within a building and that produces no noise, smoke, Smell, toxic fumes, vibration and/or electrical or electronic interference that may in any way reduce the habitability of surrounding residential areas. "Industrial use" is already defined in Section 101 of tha Zoning Bylaw so the basic elements of a light industrial use ara in placa. The requirement that the use take place entirely within a building, although a condition of use-rather than a parmitted use per se, is also clear and enforceable. _ ITEM [ PAGE : mi
