Lot 1, District Lot 232, Group l, Plan 68514, New Westminster District Lot 3, District Lot 232, Group 1, Plan 68514, New Westminster District (collectively "the Lands"). The Covenantor will not at any time construct or place, or permit the construction or placement on the Lands of any building, structure, improvement or fixture except in complete compliance with the plans prepared by Elbe, Lock, Walls & Associates Inc. attached as Schedule "A" to this Covenant and the landscape plans prepared by Matsushita, Mitchell, Elliot, Landscape Architects attached as Schedule "B" to this Covenant. Nothing set out or implied in this Covenant shall prejudice or affect the City’s rights and powers in the exercise of its statutory functions, and all bylaws, regulations and orders may be exercised in relation to the Lands as if this Covenant had not been granted. This Covenant runs with the Lands. The Covenantor shall release, indemnify and save the City harmless from and against all actions, causes of actions, loss, damage, costs, claims and demands whatsoever by any person, arising out of or in any way due to the granting or existence of this Covenant. The Covenantor will do all things in its power to obtain priority for this Covenant over any charge or encumbrance registered against title to the Lands, other than statutory rights of way. This Covenant is binding on the Covenantor and its heirs, executors, administrators, successors and assigns; every reference in this Covenant to each party includes the officers, employees, agents and contractors of each party; whereever the singular ofr masculine is used in this Covenant, the same is deemed to include plural or the feminie or the body corporate as the context so requires; waiver by the City of any default shall not be deemed to be a waiver of any subsequent default; and this Covenant is binding notwithstanding any rule of law or equity to the contrary.
