Varfance Permit to Lot 2, DL 232°and 340 Group One, Plan 71468, NWLD varying the. Provislons of the Subdivision Bylaw No. 2126, Schedule C, Design Criteria, Section 4.4.3, Driveway Grades, And that the issuance of Development Variance Permit be subject to the owner having driveway heater tapes installed. Ry COMMENTS: 1. This Development Variance Permit is being proposed to be issued for legalizing a building deficiency to alleviate injury to a third party. Under normal circumstances, a builder Is required to correct a deficiency. before carrying on work.to ‘the next stage. Unfortunately, in this case the builder not only carried on work, but also sold this home before recelving a final inspection. It is the City Bullding Inspection Departmentts withholding the final inspection approval unti}! corrections are made that is causing the new home owner difficulty. 2. It Is recommended that normal procedures to requiring the builder to make corrections be walved. It is proposed, that City Counct! issue a Development Varlance Permit to allow the bullder to [Install an alternative system to provide a level of safety for the driveway. The administration are not recommending, that normal bylaw requirements be walved because of the precedent this will set subsequent request.
