/2, April 13th, 1973 The question that arises is an exceedingly simple one and it is this: "was it the intention of the Council to transfer ownership of the portion of Kennedy Street included in Spruce Park's subdivision to Meridian Developments Ltd?", If it was the intention of Council so to do - and we believe attachments "C" and "D" bear this out (although they would appear to be contradicted by the last paragraph of attachment "E") — then its transfer to Spruce Park Properties would appear to be in order as this is part of the arrangement that Meridian Developments has made with Spruce Park Properties. We believe Meridian Developments has the right to make this agreement as it was always our understanding that Meridian Developments as the purchaser of the City's Lot 203 also purchased the entire portion of Kennedy Street now closed to traffic and the right to negotiate with Spruce Park Properties for a joint subdivision, In preparing the two resolutions for sale of the property to Meridian Developments and Spruce Park Properties we did so in the belief that there was nothing to be gained from insisting that the entire portion of property be sold to Meridian Developments Ltd. and that, in fact, it was a more proper procedure for the Council to transfer the property dir- ectly to the ultimate owner rather than have the property pass through a third party's hands. - C A222 me) RAF / vw City Clerk
