5. Canfor indemnifies the City and saves the City harmless

all claims for loss or injury to persons or to Property due to
Canfor's negligence or to Canfor's failure to comply with the
City's bylaws or any one of them Or with any provisions of this

6. ‘This Agreement shall not in any Way restrict the right

of the City at any and all times to enter in, on and upon the
area below, above or ‘around the Statutory Right of Way for the
Purpose of constructing, maintaining, inspecting or removing any
public works or utility and Canfor INDEMNIFIES the City for any
additional costs of construction, maintenance, inspection or
removing of any public works or utility which the City may incur
