=3~ “Muntetpal Engineer" shall be construed to mean and Include the City Engineer for the Munlef{pality and his daly itherfzed ass{stants or such Consulting or other Professfonal Engineers as nay be appointed to act for the Menictpality, “Municipal Planner" shall be construed ta mean and inelude the Planaing Officer for the Munic{palizy and his duly authorized uch Consultants as may be appointed to act for the Munictpallty. "Work" or "Works" or any variation of these words shall be construcd to mean and include all work required co be done for the setting-out, the execution and the completion of this Contract co che satisfaction of the Municipality, nd: 2. The Developer {8 the holder of a registered interest in ALL AND SINGULAR that certain Parcel or tract of land and premises situate, lying and being {n the City of Port Coquitlam, in the Province of British Columbia, which said land is described in Schedule "a" hereof and is hereinafter called "the land". Consents: 3. The Developer has obtained the consent of all persons holding any registered interest tn the land as set our in the Consents to the use and developzent set forth herein, which Consents are attached hereto. Uses: 4 The land, including the surface of water, and any and all buildings, structures and isproveneats erected thereon, thereover or there{n shall be used, for the purpose or purposes specified in Schedule "B" hereto and for no other Purpose or purposes whatsoever, 5. No building, structure or improvenent shall be sited, constructed, reconstructed, altered, roved or extended upon except in compliance with the plans ard specifications for the use and development of the land, approved by the Municipal Engineer, which said plans and specificattons ere hereby {acorporsted by reference and forn pert of this Contract. No sign shall be erceted upon the land or on any building or structure thereon except in compliance with the hereinbefore described plans and specifications and further subject to the satisfaction ang apptoval of the Municipal Planner, Parking: 7. Cur serect parking and loading spacea shall be Provided, Jocated and coascructed in accordance with the hereinbefore described Plans and specifications and further subject to the Satisfaction snd approval of tha Municipal Planner, 8. No land shall be subdivided except in compliance with and according to the plans and Particulars set out in Schedule “C" hereto. Landscaping: 9. All landscaping, surface treatments, fences and screens shell be constructed, located, provided and maintained in compliance with the hereinbefore described plans and specifications and further subject to the satisfaction and apptoval of the Municipal Planner. Urilities: 10. All utilities, including water, sewer, gas, telephone and electricity shall be Placed, provided and constructed in compliance with the hereinbefore described plans and specifications and further subject . to the satisfaction and Spproval of the Municipal Engineer. - Application of Provinéial Building Code ete.: 11, Except as provided herein all buildings and structures shall be constructed strictly in compliance with applicable Municipal By-laws and the Provincial Building Code, Works, Construction, Design, and Security Therefore: 12, (a) To facilitate the use and development of che land, the Developer Covenants and agrees to provide, construct and install such off-site works and services as are deemed necessary by the Municipal Engineer to serve the land and development thareon and to Pay for the entire cost of the completion of the aforesaid off-site works and services. The said off-site works and services shall be constructed and completed to the Satisfaction of the Municipal Engineer in compliance with and according to plans prepared by the Developer and approved by the Municipal Engineer prior to the granting of necessary approval and occupancy pernits by the appropriate Officer of the Municipality, Without liwiting the generality of the foregoing these off-site works and services chall include those items set out in Section 1 of Schedule "D" hereto,
