Offers may be made subject to the rezoning of the property to an RS-2 Smail Lot Residential zoning designation. Offers should clearly state whether or not they are subject to rezoning. If subject to rezoning the time for payment of the balance of the purchase price, as specified in paragraph 1(c), shall be extended until 15 days after a zoning amendment bylaw for the property has been adopted. This time limit may be extended by mutual consent. If the property is not rezoned before August 30th, 1993, (extendable by mutual consent) the sale agreement shall be terminated and all money paid shall be refunded without interest. Zoning amendments are entirely within the discretion of Council and the City does not warrant or represent that any rezoning will be advanced or adopted. No tender will be considered that contains any “subject” or conditional clauses whatsoever; except as provided in Section 5 regarding the zoning of the property. The City does not warrant or represent that the property may be used in any particular manner and tenderers who are intending to make any particular use of the property should satisfy themselves, by independent inquiry, that the use is possible having regard to ali factors, including but not limited to the bylaws of the City, other regulations, the limitations imposed by the various charges on the property’s title, and the natural features of the land. The City accepts no responsibility should any proposed use not comply with all relevant regulations or prove otherwise infeasible. Information on Zoning or other land use matters may be obtained from the City’s Planning Department. Rezoning Application Fees will be payable by the successful bidder. The property is unserviced and details of servicing requirements may be obtained from the City’s Engineering Department. Payment of all costs to fullfill these requirements and for applicable Development Cost Charges and connection fees will be required in addition to the amount bid. The Council of the City reserves the right to accept any offer or to reject any or all of the offers as the Council, in its absolute discretion, may determine.
