Several months ago City Council dealt with a similar request to this Development Permit Application, to install a door along one of the side elevations of this building. The circumstances Surrounding that application, were similar to this Development Permit Application, in that work had commenced on installing a door. In that instance work was stopped as has been done in this case. Where that instance differed from this application is that it was beside residential properties and along Taylor Avenue. This Development Permit Application is located along Ryan Street which is not a border between residential and industrial, but rather a street between two industria! properties. COMMENTS: 1. This Development Permit Application is to install an overhead door along the east side of the 1750 McLean Avenue multi-bay warehouse building. In the Land Use Contract regulating this property, there is no provision for doors along the east elevation. The original intention for that regulation was to prevent any conflict with neighbouring properties to the south. This consideration is not as important along the east elevation of the property as it is along the west side at Taylor Avenue. The reason for this lower significance is that Ryan Street along the properties east side is bordered on both sides by industrial development. The only contact with residential development is south of Ryan Street along the 20 metre berm constructed by the developers of this property. . The proposed overhead door being requested by this Development Permit Application, as previously mentioned has been constructed already. Construction of the overhead door was noted shortly after demolition of the wall was completed. Due to demolition being completed, the City forces were not in a position to prohibit the wall being closed. Immediately after, the owner visited City Hal! to discuss the: problem of constructing a door. From a survey of the site, it was suggested that the best procedure would be for the owner to apply for a Development Permit. Initially, the approach taken in discussing this overhead door was to require the wal! be reconstructed. After having viewed the site and determined that it is not visually prominent as was the overhead door along Taylor Avenue, a modified approach was taken. The approach that has been taken with the applicant is as follows. A. The appticant is to plant additional trees along the berm at the south end of their property. B. Access to the overhead door along Ryan is to be by way of a sidewalk along McLean Avenue into the developments parking lot. The reason for requiring access through the parking lot is that direct access onto McLean Avenue by way of Ryan Street is at a blind intersection and would be dangerous. 30
