Re: Registration of: Right of Way on City Property

Recommendation:

That the attached Statutory Right of Way Agreement wherein a Right of

is granted by The Corporation of The City of Port Coquitiam to the
Corporation of the City of Port Coquitiam over a portion of Lot 2,
District Lot 463, Group |, Plan 69169, New Westminster District shown
on the attached Right of Way Plan be and the same is hereby approved;
and | _

That his Worship” the Mayor and City Clerk be authorized to execute the
said Agreement on behalf of the City and to affix the City's Corporate
Seal thereto. | | |

Background and Comments: . | |

Council will recall that Mr, Galer, of Poco Building Supplies, had
recently purchased a strip of land from the City along his south
property line. Two of the conditions of Sale were the filling in of
the ditches located within the strip of land and ‘the construction of a
storm sewer on city property immediately south of the strip of land,
both at the expense of Mr, Galer. Since the storm sewer installation
has now been completed, we are therefore in a position to register a
Right of Way ever the storm sewer to ensure that a maintenance
corridor is preserved for the future of this property. -

While it may appear to be unnecessary. to grant a Right of Way to
ourselves Council. must be mindful that the sale of this property jn
the future is likely. By taking this step to register the Right of

Way now, the City dan be assured that regardless of who owns this

property in the future, the integrity of the storm sewer can be
