Tunsday, ay 3ist, 1977, Because of a request was mode for a special Council Neeting this . in order to qive them more time to finalize all the . necessary legal work hefere the expiry date is reached. it was indicated by the undersigned that this request would have to be rade directly to Council, Nevertheless this request was discus- go at the Public Yorks Committee Meeting and the Committee felt that the recuest for a special Couneil Neeting was not one that ould be readily acceded to. I have today indicated to the feveosers the feelings of the Public Works Committee and as a result there will be no request for a special Council Meeting in order to give fourth and final reading to the by-laws. The Peblic Works Committee did suggest, hovever, that wy this memorandum the problems that the developers have with the May 3lst, 1977 expiry date be mentioned and a suqgestion was made that should there be any questions that members of Council would have regarding the developments and the City/s involvement with the 13 lots on the west side of Taylor, they could perhaps he handled this week in addition to during the . Council Meating Monday, May 39th, 1977. It would appear that if these three developments do not receive fourth and final reading on Monday, May 39th, 1977 they will not go ahead at this time. Eng., City Engineer Re: Three Proposed Rez“ning Applications - Langan, Warwick, Taylor, Brown Area - R£3-75, R#15-76, and R#17-76 Late last year the Council, in giving tentative approval to the above mentioned proposed residential devel- Opments, also endorsed the participating with the three develupers in the construction of Taylor Street to enable the servicing of 18 City-owned lots on Taylor Street (see attached correspondence dated September 17th, 1976, September 22nd, 1976, October 7th, 1276 and October 22nd, 1976). Lengthy and compli- cated discussions and negotiations. have taken place since October last year to the point where it is possible to recem- mend that the Council give fourth and final reading to the three rezoning applications. The following points should be considered as relevant information and/or part of the recommendation to proceed, ; 1. Earlier this year, one of the three developers (First Equity Ltd.) stated that he was not prepared to proceed as quickly as the other two developers, It was pointed out that the original Council tentative approval and the cost-sharing on Taylor were predicated on the three developments proceeding as one, and that the withdrawal or extended delay by one of the developers would possibly jeopardize the three developments pro- ceeding, First Squity Ltd. has now sold the property to another Developer (Double Gold Holdings Ltd.} who has completed other residential developments in the City satisfactorily and who is prepared to proceed immediately. . 2. The original participation by the City was to involve sharing in the cost of the construction of Taylor Street. In fact this has proven to be virtually unworkable and could prove very difficult in resolving costs that cannot be determined exactly at this time. The City has 18 lots and the three devel- opments will have 68 lots for a total of 86 lots. It is recommended that the City share be established as 18/86 of the entire develop- ment servicing cost. This will result in very little change to .: the total amount the City would be responsible for and should simplify the resolution of costs not yet determined exactly. [dover
