In the event Westview requires design of any Section of
the Works either fronting on Genstar's lands or on
Genstar's lands, Westview will so advise Genstar in
writing, prior to Proceeding with such design. Genstar

Works as outlined by Westview in writing and Genstar

construction drawings Satisfactory to the City for such
Section of the Works. In the event Genstar has not so

for the Purpose of obtaining the required survey and
other relevant engineering design information. Genstar

Payment of the same to Genstar. Westview will be

entitled to recover any and all monies so expended as
Provided in clause 4 Of this Agreement. tn the event
the consulting engineer employed by Genstar does the

consulting engineer, Providing proof of Payment of the
same to Westview. Genstar will be entitled =o recover
monies sO expended as Provided in clause 3 << this
Agreement. If work performed in accordance with this

responsibility of Genstar to pay for such work.
Similiarly, if work berformed in accordance with this
Paragraph is for the sole benefit of Westview, it is the
responsibility of Westview to Pay for such work.

All engineering design costs associated herewith shal]
be reasonable and determined on the following basis for
Clauses 1.6, 1.7, and 1.8:

(a) engineering design costs will be 3 and 1/2% of the
applicable Construction costs; and
