Kirk DATE: Qctober 17, 1991 City Administrator FILE: 17/90 and 18/90 Carlos Felip Director of Planning 1921 and 1937 Broadway Street Rezoning and Development Variance Permit Application Planning and Development Committee - October 16, 1991 That Council grant a one-year extension to Rezoning Application 17/90 and Development Variance Permit Application 18/90, subject to the Provisions of the Development Procedures Bylaw, 1987, No. 2243. BACKGROUND: The subject rezoning received third reading on August 13, 1990. The Development Variance Permit received initial approval by Council on June 25, 1990. Under the provisions of the Development Procedures Bylaw, the project “shall not be considered for (final) adoption" unless Council extends the time for consideration of adoption. The applicant has sent the attached letter indicating that it is their intention to proceed with the project very soon and requesting an extension. In discussions with the Planning Department, the applicant has indicated that they had some problems raising the necessary monies to proceed with this project, however these are now in place and they have now made application for a building permit. The applicants are proposing to develop a 8592 ft? multi-tenant warehouse building, with five leasable bays, which require a Development Variance Permit to relax the rear yard setback requirements of the M--3 zone, from 9 m (29.5 ft) to Om, and to permit loading bays in the front yard. These relaxations were approved by the Planning Committee and Council because the placing of the building as proposed is consistent with other developments in the same area of Broadway Street.
