Pursuant to your instructions, i have perused the above noted By-law; the draft By-law to amend it; Section 719A of the Municipal Act; Order in Council No. 1765(B. C. Reg. 140/73) and Order in Council No. 3574 (B. C. Reg. | 396/73) .° In my opinion the proposed amendment attempts to do indirectly what the Municipality cannot do directly. That is, the Municipality seeks to impose the National Building Code upon mobile homes and factory built housing. You have advised me that the Council wants to permit factory built residential buildings to be brought into the City but not mobile homes. To my mind, it would be quite simple to prohibit both of them under the au- thority of Section 714(g) of the Municipal Act, however, this does not meet the requirements of your Council. I would suggest that your proposed Section 2A be amended to. read as follows: "(2A) Sub-section 2 of this section shall not apply to new factory-built housing certified by Canadian Standards Association as complying with Canadian Standards Association, Standard #277 which is to be erected on a site in com~ pliance with the By-laws of the City."
