Pollock, City Administrator, May 25th, 1972. ‘Stondardization of Building Codes: Council will recall that in the 1971 amendments to the Municipal Act 2 covision was made for a standardized building code based on the National Building Code with the added provision that the Lieutenant-Governor in Council has the power to make certain re- gulations respecting Plumbing and Building Codes. In effect the provision wili provide for a standard building code for the whole province and no Municipal By-law will be valid un- less it is consistant with the standard By-law. It would appear that municipalities still 7 maintain authority in certain areas particularly with respect to moving of buildings and demolitions or bringing up to fire limits and permit fees, etc. The amendment mentioned above has not yet been proclaimed by the province and ‘it is not yet in effect, however, it will be instituted shortly. The Province some ‘time ago circulated a draft by-law for consideration of municipalities. This By-law was dealt _with by a technical sub-committee which reported to the Regional District. Mr. Chernoff, our Coief Inspector was a member of this Committee and attended 2 number of meetings at which the Proposed by-law was discussed and as a result of the sub-committee's work a modified by-law was drawn up. Mr. Chernoff feels that the by-law is more functional and would endorse the by~law as revised by the technical sub-committee. He has, however, ; added the following comments: . . 1, the proposed building code does not contain a house moving section. (I believe this is still within the jurisdiction of Council under another section of the Municipal Act); the proposed building code doesnot contain completion date requirement; the. proposed building code would permit factory built houses that may. be considered unsatisfactory by Council; the proposed code contains no regulations on private swimming pools; the exterior sheething is not required in the proposed building code, we presently require this in all construction. A-copy of the Provincial draft was circulated to Council members some ‘time ago and the draft by~law prepared by the technical sub-committee which has been approved .by the Regional District will be circulated for Council's information. The Department has requested our views to the by-law by the 31st of May and in view of Mr. Chernoff's comments it would appear that the draft: by-law prepared by the technical sub-committee - would be worthy of endorsement and we might convey to the department the few points listed above where Mr. Chernoff feels the by-law is deficient.
