herbicides and pesticides shall not be used by Port Coquillam on the
Reserve or off the Reserve immediately adjacent to the Permit Area
without the consent of the Minister and the Band;

the maximum amount of vegetation shall be retained on and in the vicinity
of the Permit Area, subject to requirements for public safety or the
effective exercise of this Maintenance Permit;

Port Coquitlam shall maintain, repair, operate and inspect the Dyke auld
associated works in a proper and workmanlike manner in accordance with
good dyking practice to a standard equivalent to other dykes in the ar
and with proper drainage, insofar us the construction of the Dyke allow:

forthwi: after Port Coquitlam completes any maintenance, repair,
operation and inspection of the Dyke and associated Works, it shall clean
the affected portions of the Permit Area, removing any of its materials or
equipment as are no longer required and raking up all rubbish and ceri
and restore the surface of the Permit Area as nearly as possible to the
same condition as existed prior to the commencement of such work;

(e) any fences, gates or structures damaged by Port Coquitlam during
maintenance, repair, operation and inspection of the Dyke and associa
works shall be repaired or replaced by Port Coquitlam,

(f) all applicable environmental legislation shall be dhered to; and

(g) all mitigation measures in the EARP screening cision shall ‘e adhered
to.

The City shall repair any damage to the Band’s land or chattels caused by th
City in carrying out its activities under this Permit.

APPLICARLE LAWS

With respect to this Maintenance Permit, Port Coquitlam shall comply with all
applicable laws, bylaws, requirements, cirections, order, ordinances, rules and
regulations.

For greater certainty, Port Coquitlam shall observe and comply with by-laws
the Band, provided that such bylaws are applicable to Port Coquitlam with
respect to its rights pursuant to this Maintenance Permit, are not inconsistent}
this Maintenance Permit and are identified to Port Coquitlam. oe
