Shimizu grants to the City the non-exclusive right at all times to enter over, along or upon that portion shown boldly outlined on Statutory Right-of-Way Plan prepared and certified by W. Papove, British Columbia Land Surveyor, and dated April 18, 1990, a copy of which is attached hereto as Schedule "A" (the "Right of Way") of the parcel of land situated in the City of Port Coquitlam in the Province of British Columbia legally described as: Parcel Identifier 000-555-924 Parcel 1 (Reference Plan 6040) Except Parcel "E" (Explanatory Plan 8564), Sections 18 and 19, Block 6 North, Range 1 East, New Westminster District (the "Lands") 2. Shimizu grants the Right of Way to the City for the following purposes: (a) access over, along and upon the Right of Way by pedestrians, bicyclists and people on horseback, and inspection, maintenance and repair of: (i) the dyke located within the area of the Right of Way and running parallel to the Pitt River (the "Dyke"); and ii) the Pedestrian Overpass (the "City Works").
