SUBJECT: Sewer Backup - 3935 Pimlico Place RECOMMENDATION: That the City request permission of the Ministry of Municipal Affairs to make an ex gratia payment, as permitted under section 288 of the Municipal Act, in the amount of $1,337.12 to the owner of the above mentioned property. BACKGROUND & COMMENTS: The owner of the above mentioned property returned from his vacation to find sewage backing up into his basement. Standard procedure when people are working on the alarm system at one of our pump stations calls for the place- ment of a "disregard alarm" sign on our remote panel at the Fire Hall. The procedure also calls for the person installing the sign to remove it when the job is completed, a contractor working for us did not remove the sign and when a backup occurred the alarm was ignored resulting in sewage backing up into the basement of the above mentioned property. The City has had two adjusters opinion's on the incident, the first one indicated that there was no negligence on the part of the City, the second Opinion is that "the City could be as much as 25% at fault". The contractor's adjuster has also denied responsibility. The recommendation addresses the concern of the property owner who through no fault of his own had his basement covered with sewerage.
