WHEREAS The Grantor is the registered owner of that property in the CITY OF PORT COQUITLAM in the Province of British Columbia, more particularly known and described as: PARCEL IDENTIFIER LOT 1 BLOCK "A" DISTRICT LOT 289 GROUP 1 NEW WESTMINSTER DISTRICT PLAN AND WHEREAS the said lands or part thereof, could reasonably be expected to be subject to flooding: AND WHEREAS Section 215 of the Land Title Act provides that there may be annexed to any land a condition or covenant in favour of the Crown that the land or any specified portion thereof is not be built on, or is to be or is not to be used ina particular manner; AND WHEREAS the intent of this Agreement is to reduce the flood potential of areas within buildings used for habitation, business and storage of goods susceptible to damage by floodwaters; NOW THEREFORE in consideration of the premises and covenants herein contained, the Grantor covenants and agrees as follows: 1. Hereafter, no area used for habitation, business, or storage of goods damageable by floodwaters shall be located within any building at an elevation such that the underside of the floor’ system thereof is less than seven point one (7.1) metres Geodetic Survey of Canada Datum. In the case of a mobile home, the ground level or top of concrete or asphalt pad on which it is located shall be no lower than the above described elevation.
