PAGE 4, THE HERALD, Friday, November 4, 1977 Pregnant stewardesses to appeal Supreme Court VANCOUVER (CP) — The Canadian Airlines Flight Attendants’ Association says it will ask the Supreme Court of Canada for a ruling in the case of two flight stewar- desses who were grounded because they were pregnant, Rather than appeal the lower court ecisions aequittin Pacific Western Airlines, however, the union wants the court to give an interpretation of the Canada Labor Code that would clear up several questions about the options open to pregnant stewardesses. Ina letter tofederal Labor Minister John Munro, which requests the Supreme Court interpretation, union lawyer John Laxton noted that the jobs of pregnant women are protected both by the jabor code and by the union’s collective agreement. Quebec women not separtatists VANCOUVER (CP) — Quebec women are not separatists, former senator Therese Casgrain said Wednesday. Ms. Casgrain, white- haired but still vigorous and vociferous at the age of 30, said in a lecture sponsored by the University Women’s Club that Quebec women are too practical ‘to favor separatism. “The majority of them have too much hard com- mon sense,”’ shesaid. ‘They have a sense of the economics.” Ms. Casgrain, a Com- panion of the Order of Canada and Quebec president of the League of Women’s Rights from 1929 to 1942, said Quebee women are aware of the poor economic situation and the high unemployment rate. Although they want to speak French, they know that in a world where English is the language of economics, people must learn that language to get anywhere, she said. Things are changing in Quebec and women are now “coming out, speaking out and being elected in the political field,” she said. “Now women in Quebec are not second-class citizens any more. In the taped interviews with two psychiatrists, Berkowitz, a 24-year old former postal worker, tells of demons urging him to kill so that they could rape the victims’ souls forever. The tapes were released Wednesday to the New York Daily News as one of the last official acts of 71-year-old Judge John Starkey, who has since removed himself from the case. The release of the tran- scripts prompted the new judge in the case, Joseph Corso, to order all Berkowitz documents, tran- scripts and pieces of evidence sealed. One of the defence lawyers said Thursday he will seek a change in venue in the case because of the circus-like pre-tria publicity. But lawyer Ira Juitak de- clined to criticise Judge Starkey. ‘This is just one story in a sea of stories," he said. A hearing has been set for Noy. 28 to determine a trial date for Berkowitz who is accused of killing six people and wounding seven others in a 13-month reign of terror in New York City. ‘Despite psychiatric testimony that Berkowitz was “emotionally dead’ and cannot aid in his own defence, Judge Starkey ruled he was mentally fit to stand trial. In the psychiatric tapes, Berkowtiz is heard to say he lurked the streets of New York for his victims at the order of demons. Berkowitz said the demons were ‘too real to be called delusions’? and had robbed him of all human feeling. same rights, they can do exactly what they want, they can go into the professions if they want.” Ms. Casgrain expressed little affection for Quebec Premier Rene Levesque, but said he has succeeded in making Canadians realize what their country means to them. She said there is a noisy minority of young people who support the Parti Quebecois, but the majority of them don’t. Support to Counter attack VANCOUVER (CP) — Hotel management and employees say they have banded together to support the British Columbia government’s Coun- terattack program against drinking drivers. The British Columbia Hotels’ Association and the Hotel, Restaurant, Culinary and Bartenders Union said in news release that the ‘program will use the theme: - Know Your Limit. It is to include province- wide radio announcements ; distribution of handbills; area meetings between management, union members and the police to discuss areas of common concern; and efforts to publicize the seriousness of drunk driving. Association past president Frank Burger said the program is both responsible and of benefit to the com- munity. “Patrons and the public must realize that over- consumption of alcohol is dangerous to themselves and bystanders,” he added. He also noted that the benefits under the two differ and that some pregnant stewardesses may prefer the henefits of the code and others those of the agreement, — Laxton said Wednesday the union wants the court to deal with the question of whether its female mem- bers may choose between the two. The case, brought against PWA by the federal labor department, was heard ‘in Surrey, B.C., provincial court two years ago and then appealed, first to the county court, then to the Court of Appeal, both of which confirmed PWA’s acquittal. . ’ QUESTION AROSE Laxton pointed out that during the appeals | the question of whether the code or the collective agreement applied came up. He said this puts the union in a_ difficult position because an arbitration board rather than a court is the proper forum for in- terpretation of a collective agreement, “It is fairly safe to say that this prosecution was begun, not with the aim of penalizing the company, but -aS a means of stttling the rights of women who prefer the maternity leave benefits provided by the Labor Code,”’ he said. “It appears in retrospect that the better method of having these rights deter- mined by ‘the courts would have been for the union tc have applied for declaratory relief from the courts... “It is now obvious that if the Supreme Court of Canada deals with the problem by way of an ap- peal from the present deci- sion of the court of appeal, the rea] question of womens’ rights under the Code ma continue to be dealt wit inadequately. w duthie BOOKS write for catalogue to Duthie Books Ltd. 919 Robson Street Vancouver, B.C, V6Z 1A5 McCOLL REAL ESTATE SERVICES A.J.
