withio the City of Pert Coquitlan,

MMEREAS under Section 868 of the “Muntespal Act", being Chapter 255
of the Revised Statutes of British Columbia, 1960 and Amending Ac 1, the
Council cf the City of Port Coquitlam may by By-law regulate or prokibit the
cutting cf trees from any lands within the City, or vithin sny area within
the City, and require the holding of a permit for such purpose and fix a fee
for such peruit and different regulations end prohibitions may be sade for
different areas;

AND WNEREAS it is deemed expedient thst the cutting of trees within
the City be regulated;

NOW THEREFORE the Municipal Council of The Corporation of the City of

Port Coquitlam, in open Beeting assendled, enacta as follow:

1 That in this By-lew:
"City" shall nean the geographic area of The Corporation of the City
of Port Coquitian or any part thereof.

“City Adainistrator™ shall mean the City Admini

of the City of Port Coquitles, or hi, dalegate,

“Council” shall man the Municipal Couacil of The Corporation of the
City of Pore Coquitlan.

“Cutting” shall mean the cutting down or cutting so as to permanently

damage any tree, but shall not include beneficial pruiing of a tree,

“Permit™ shali mean the vritten authority granted by che City Adminiacrator

for the cutting of trees fron specified land within the City cpon the
‘arus, conditions and olans and spec! fications applicable to tks
application for such removal,
2. (a) Ho person, fire or corporation, shall cut or cause to be cut or peraic
the cutting of any cree in excess of Fifteen (15) feet in height frou any land or
lands within the City unless a permit for such removal is firet iasued by the City
‘Adainistrator pursuant to the Provisions of this By-lay.

{b) ALL cuteing of trees shell be in accordance with che permit issued.

on the form prescribed in schedule hereto, which said Schedule ia hereco

annexed and wade part of this By.

(o> A permit may rot be transferred or assigned,
4, Applicetions for pernits will be accepted only from the owner or
owners of the land in respect of which the permit is applied for. Application
shall be made co the City Administrator and shall be accozpanied by the requisite
information, data, plans, and specifications hereinafter required.
5. An applicant for a Permit to cut @ tree pursuant to the provisions of
this By-law shall provide:

(2) The reason for which the tree or freee is to be cut,

(>) Details of development of the area to which the cutting of trees is
Proposed and without Limiting the generality of the foregoing the said placs
shall contain or shall be accompanied by a statenent containing the following

information:

a, ALL « buildings, structures and
tree cover.
The methods proposed to control che erosion of the soil from wy
slopes of the land or any adjacent land.
The proposed methods of access to the site during the cutting.
The proposed methods of cutting including any safeguards to ensure
that no hazard to husan or animal life exists,
Satisfactory evidence that the Person or firm responsible for che
Cutting ia covered by adequate LMability insurance.
Such further and other information as the City Administracor may
Tequire,.
6. Each and every perait iscued pursuant to this By-law shall be subject

to the following conditions, unless otherwise provided for in writing thereon:

(a) ALL damage to municipal drainage facilities, roads or lanes, or other
municipally cumed property reaulting from the tree cutting therefron shall be
repaired, All drainage facilities shall be kept free of eile, clay, sani,

tubble, debris, grovel and any other catter or thing originating frou any tree

curting upon the lands and premises and g ab to such d
