Birch Ave. in Terrace thought they were well on their way to establishing The King’s Castle Play and Learn Day Care centre in town... but they were wrong. After Neil Courtney explained to Terrace city council that a lease arrangement fell through and they wanted to operate from their home for a period of one year while they established a permanent centre, counci] came up with a plan to accommodate him. They decided they could rezone the Courtney property from single to two- family residential and attach a legal. covenant allowing them to operate. their daycare from their home for a period of only one year. Council was told by city planner Marvin Kamenz that legal advice indicated that the covenant idea was bad and the way to go was to establish a new residential zone, R1.1 Single Family Residential Child Care. But he added, "The new zone would not restrict the "duration of the day care use to one year as ‘intended by the covenant originally considered."
