Recommendation:

That the Mayor and City Clerk be authorized to execute individual or a
collective forms of Discharge of a No Building Covenant (No. AB 210195) a, Do
registered against al] lll lots of the first phase of the Westview Heights a rr
Subdivision provided that the City Engineer certifies that the relevant pe
conditions of the Master Developer's Agreement have been satisfied.

Background and Comments:

At the time of approving the Westview Heights Subdivision, the City ' a
imposed a "No Building" Restrictive Covenant over all of the lots created. The ane
purpose of this Covenant is to provide additional protection for the City in OO
the event that the developer fails to fully comply with the City's
requirements. The intention was to arrange for a blanket or collective
discharge of this Covenant over all of the lots once all of the City's
requirements are met. As Council members know, we have not reached this point

yet. eb

In the mean time, some present owners of lots within the phase 1 _ = :
subdivision (see attached drawing) have requested that this Covenant be | a
discharged so that the sale of their properties can proceed. At the regular
Council meeting of October 30, 1989 Council approved the discharge of this : oe
Covenant over lot 66 on the recommendation of the City Engineer. Presently, Po
the owner of lot 3 has submitted a similar request (sample of discharge form BOE a |
attached). It is conceivable that more of these requests will be made in the : a
future. From an administrative point of view, the Committee agreed that it ! :
would be much easier to approved the above recommendation instead of dealing -
with each request individually with a separate report to Council.
