All roadway improvements and utilities, including water, sewer, gas, telephone, and electricity shall be placed; provided, and constructed in compliance with and according to the plans prepared by the Developer and approved by the City Engineer. 12, The Developer covenants and agrees to apply for a building permit under the provisions of the "City of Port Coquitlam Building and Plumbing Code Administration Bylaw, 1974, No. 1298" and pay the requisite building permit and plumbing permit fees prescribed therein plus the sum of $1,200.00 which said sum the City shall credit to the Waterworks Utility Capital Replacement Fund. 13. (a) To facilitate the use and develooment of the land, the Developer covenants and agrees to provide, construct and install such off-site works and services as are deemed necessary by the Engineer to serve the land and the development thereon, and to pay for the entire cost of the completion of the aforesaid off~site works and services. The said off- ,8ite works and services shall be completed to the satisfaction of the Engineer’ in accordance with plans and specifications as approved by the Engineer prior to the granting of necessary approval and occupancy permits hy the appropriate officer of the Municipality. Without limiting the generality of the foregoing, these off-site works and services shall include those items set out in Section "A" of Appendix 8 hereto. In ' addition, the Developer covenants and agrees to pay to the Municipality the entire cost of connecting all required water, storm, and sanitary sewer services to the said buildings. (b) As security for the due and proper performance of the landscape plan (L1) attached hereto as Appendix 6 the Developer covenants and agrees to deposit with the Municipality by Letter of Credit the sum of drawa on the Granville Square Branch of the Bank of Montreal. The Municipality acknowledges that it may take a period of several years to complete the landscaping details in Appendix 6 and thac the amount of the Letter of Credit may be altered from time to time to reflect the progress made in completing the landscape plan aforesaid. (c) As securlty for the due and proper performance cf all the covenants . and agreements in this contract contained (except the dandscaping herein- before referred to) the Developer covenants and agrees to deposit with the
