Eng.,; City Engineer SUBJECT: Chain Link Fence on Public Property at River Place - Public Works Committee, March lst, 1983 RECOMMENDATION: That the G.V.H.C. be allowed to retain the chain link fence adjacent to the dyke until such time as 90% of the units in the River Place development have been occupied, provided that the City will continue to allow the Strata Council of River Place to use the public green space as part of the amenities of the development, once the fence has been removed, so long as they are prepared to maintain it. BACKGROUND AND COMMENTS: One of the requirements of development of the River Place. housing was the dedication to the City of e 100 ft. strip adjacent to the river for public use. Part of this strip is occupied by the dyke and the remainder has been landscaped by River Place and contains a small playground set. River Place has been experiencing a certain amount of vandalism and theft from the property. In order to improve their. security they have built a chain link fence all around the public green space adjacent to the dyke so that it becomes, in effect, part of their own development. There is a pedestrian access provided through the fence in order to allow access to the footbridge. After pointing this out to the developer, we have received apologetic letters from G.V.H.C. indicating that they erred in installing the fence but requesting that we allow them permission to retain the fence on the understanding that they will remove it whenever the City decides to develop this strip as park. The City, of course, has not specific plans to develop this strip as park since the original intention was to leave this: as an undeveloped linear park. The Committee feels that we cannot allow the precedent to be set of having part of this public strip reserved for private use. However, the Committee recognizes the security problem and is prepared to recommend that the fence be allowed to remain until- such time as 90% of the units are occupied.
