above, the Land Use Contract prohibit the Developer from moving on to the next phase until building permits for 75% of the houses in the previous phase or phases have been taken out. This provision should assist in ensuring that the houses from the project come on the market in an orderly fashion spaced throughout the time span originally agreed to by Council. The Developer, on the other hand, has proposed that the single control date used in the Land Use Contract be the occupancy permit date and that the 75% provision not be included. It would be appreciated if Council would issue instructions on this particular point. 5. A provision is contained in the Land Use Contract requiring the entire land development project ~ but not the actual house construction - to be completed by December 31st, 1983, and after this date the Land Use Contract will lapse, the undeveloped land will revert to its original zoning and thus, for ail practical purposes, a reference to Council will be necessary before further development can take place.
